So Dean Moriah's murder was NOT a homophobic killing ....... ethical issues in advocacy arise yet again

As the video above showed the awful demise of a member of the MSM population in recent times many persons local and abroad were led to think this was another case of Jamaica acting out its "most homophobic label" we now see that this case is not a homophobic murder as was made to be believed and as so eagerly reported by some advocates namely Maurice Tomlinson, Dwayne Brown on his Minority Insight blog and even as far away as the United Kingdom by our good friend Peter Tatchell when he participated in a protest at the Jamaican consulate office as was carried on my sister blog GLBTQJA complete with a press release and photos of the activity. The Gleaner carried an update on September 20th on the matter as excerpted here:

UPDATE: Man Reportedly Confesses To Murder Of MoBay Hospitality Worker Dean Moriah

The man held in connection with the murder of hospitality worker, Dean Moriah, has reportedly confessed to the killing.

The man, who goes by the alias, 'Mario', was picked up on Monday by the police in Oracabessa, St. Mary and was later transferred to the Montego Bay Freeport station in St. James.

He was reportedly held with Moriah's stolen motor vehicle.
He was also found with Moriah's wallet and was reportedly wearing a pair of his shoes.

It is believed he was a friend of the deceased, and was identified in a photo in Moriah's kitchen.
Moriah died on August 29 from stab wounds to his chest and neck.

His house was set ablaze by the attacker who also stole his car and cellular phone.
Moriah, who named his killer before he died, was buried last Saturday in Haughton Grove, Ramble, Hanover.

Dwayne Brown in his own defence tried to play walk between the raindrops when he was confronted by other younger activists as to the truthfulness of his coverage of the matter on his blog on Facebook he made the following comment: "The report did not make a definitive statement as it relates to the accused affiliation with the victim...Using word such as 'believed' is one of uncertainty and speculation. the report has no proof to substantiate such belief. Beliefs aren't facts..." So it is when one is cornered they try to worm their way out of it but I am not surprised they learn from the best anyway. I have learnt over the years in this business that despite how a case may look as homophobic on the surface one has to wait for better particulars to come out before jumping to conclusions and screams of homophobia in the international arena to gain attention only to be left with a stench of liar liar pants on fire emanating from one. The grapevine had already concluded that it was non homophobic matter and in Jamaica that modality though termed as hearsay is very important given the scheme of things.

Jamaicans are very astute these days when it comes to reports on the news with certain variables involved; a (partially) nude male deceased; untouched home; stolen or missing car; possibly used condoms; neighbours accounts of male visitors etc. once those items appear the conclusion is already drawn before the real evidence is presented but the response should not be to scream homophobia the moment the story breaks. Lest we also forget the Big Gay Lie article from child rights activist Betty Ann Blaine where she made putrid the calls of homophobia and also never forget the parting shot from Les Green the UK born police commissioner as well where he said the gay lobby's claims were not true both can be seen HERE and HERE.

It seems we have not learnt from the numerous episodes of similar cases and even recent ones of the homeless MSM murdered on June 13, 2012 where JFLAG's ED was called out on the matter after they rushed to a conclusion only for it to be revealed it was a gay on gay crime. Dionne Jackson Miller host of RJR's Beyond the headlines had pointed on June 28 2012 that:

"The men were apparently brutally murdered with blunt instruments in the vicinity of the intersection of Trafalgar Road and Lady Musgrave Road. Persons who are homeless frequented this area; among them are young gay men who have been made homeless because of the continued intolerance of homosexuality in Jamaica.”

In an interview with me on my radio programme Beyond the Headlines a few days later, JFLAG spokesman Dane Lewis admitted that the organisation had jumped the gun, and that his later information was that the two men in question had been killed by members of the gay community. He said he withdrew that part of the statement and promised a corrected version. I haven’t seen that yet."

JFLAG has since removed their statement as well on the Dean Moriah matter too from their website but all these mishaps in reporting and agitations have only sought to rob the lobby of any credibility thus affecting any campaigns and position statements that may follow no matter how virtuous they are intended to be but when will all concerned learn? one would have thought that after fifteen years around they and others individual spokespersons (nominated self appointed or otherwise) would know how to handle such issues by now instead we have mistake after mistake occurring with disastrous consequences, the Queen Ifrica matter anyone? and it's lack of ownership in so far as the Stop Murder Music Campaign is concerned and letting it slip to a quickly formed overseas group with Jamaican membership who managed to get the artist work permit cancelled but ha snow left the perception of free speech stifflers added as another layer to the struggle that we did not need. But again I ask who cares? as long as the headlines are being made and the funders continue to be led so be it, truth and objectivity have no place around here.

Anyone notices locally that hardly any thing can be said as of late and local media seems not amused as to how the Queen Ifrica matter was handled? Notice too that it is only overseas online publications that are being worked to the bone to promote supposed agitation for rights, then we wonder why the cynical public that must be convinced is adamant that homosexuality is being foisted on the nation.

To get rights basically by fiat as it were or arm wrenching in the minds of the people whose minds we want to change is not by idea of full freedom as we may find ourselves always looking over our shoulders with a finger pointing opposition reminding us "you lied your way to them" I much rather preferred unfettered enjoyment of same if and when they come, after all King, Gandhi and other freedom fighters did not leave any doubt as to the veracity of their work for their struggles.

Think on these things.

Gay Protest Against Jamaica Fizzles Outside UN Assembly

A planned protest by gay lobbyists 'Jamaica Anti-Homophobia Stand', today fizzled outside the 68th United Nation General Assembly, where Jamaica's Prime Minister Portia Simpson Miller is in attendance.

The lobbyists had posted on their blog that the group would have been joined by organisations such as Queer Nation, ACT UP and the Lesbian and Gay Democratic Club of Queens in Manhattan.

But only four people turned out to protest today.

They were demonstrating against recent attacks on alleged gays and a transsexual in Jamaica.

They also want the Government to repeal anti-sodomy laws.

The lobbyists say on Saturday September 28, they will stage another protest against Simpson-Miller at the United Nations Plaza in New York.

This latest campaign follows a series of social media activities by the gay community including Jamaican born-gay activist, Maurice Tomlinson.

So now here we are seeing the desperate grasping for straws with little success as unplanned and sparadic activities just cloud the credibility more on behalf of the rest of us and we sit or I should say others sit quietly and watch this go down and think it ok, here is a clip from the heckling:




I knew that the perceived promise by Mrs Simpson Miller when she was opposition leader in the leadership debate was nothing to hang on to, we should know by now how politicians operate and besides the present economic, ethical and legal problems now plaguing the administration I doubt we will see any buggery debate or conscience vote anytime soon.

Sentiments expressed by many Jamaicans but who inside the lobby pays close attention and thus prepare proper responses for stuff like this? I guess noone as they have all become so impervious.

The Church, Buggery and the Constitution

The debate on whether there should be an amendment to the provisions of the Offences Against the Persons Act which make buggery a crime has been generating a variety of views from a wide cross section of the population.
Religious leaders are also giving their views as they are entitled to. They have in general grounded their opposition to homosexuality in Biblical doctrine.
It is my opinion that many of us Jamaicans who oppose homosexuality do so out of concerns about issues such as morality and health and in particular our concern about the spread of HIV/AIDS which is known to be prevalent amongst homosexuals.


Over the weekend Pastor Greg Baldeo of the Mandeville Seventh Day Adventist Church gave his opinion on the matter in a strong and firm way. Pastor Baldeo made it absolutely clear that he opposed same sex marriage. He went on to declare that he will continue to oppose same sex marriage unless God declares it to be acceptable.

However, Pastor Baldeo went beyond his religious belief to compare the Supreme Court of Jamaica with God and to compare the National Flag with the Christian Cross. He also compared and contrasted our Constitution with the Bible. In so doing Pastor Baledo advanced his argument to the point of declaring Jamaica a country ruled by Christianity, specifically the Bible, and I suppose the Seventh Day Adventist doctrine in particular, and not by the Constitution or the Supreme Court.


In this ongoing debate about the Buggery Law, the religious leaders must not forget that Jamaica is a secular state. They must not forget that Jamaica is a state grounded in a Constitution that confers freedom of expression and freedom of religion on all its citizens. That means that it is in inappropriate for any one religion or denomination to determine right or wrong for the State.
It is therefore inappropriate to compare and contrast the Constitution with the Bible and then suggest that we are governed by the Bible and not by the Constitution, nor the Supreme Court. Christians are entitled to conduct themselves by whatever interpretation they give to the writings of the Bible.

Muslims are entitled to conduct themselves in accordance with the Quran. The Jews are entitled to conduct themselves in accordance with the provisions of their holy book, the Torah. The Hindus are entitled to conduct themselves in accordance with the provisions of their religious books including the Bhagavad Gita and the Vedas. The Sikhs are entitled to conduct themselves in accordance with their holy book the Guru Granth Sahib. The Baha’isare entitled to conduct themselves in accordance with the Kitab-i-Aqdas, their Book of Laws.


Our Rastafarian brethren and sistren are entitled to conduct themselves in accordance with the various abstracts they have taken from the Bible and the various writings they have been compiling over the years as they develop and formalize their religion.
However, all these religious groups should respect the Constitution and the Courts of the land and be prepared to abide by whatever laws are made in the country.

CHURCH RULES

To declare the Constitution of Jamaica to be not the law of the land is the first step towards religious fanaticism and it can be said that Pastor Greg Baldeo is embarking on a course where he hopes to set up his brethren and himself as rulers of Jamaica in the same way that the mullahs rule some countries over which they exercise religious powers.
Religious leaders should encourage tolerance for even those who they consider sinners. Rather than relying on the State to convince persons to go the way of their religion they should make their light so shine that men will come to glorify their work and join them in their religious glory.
If we give strict interpretation to all provisions of the Bible then it is not only Buggery that should be a crime but so too should fornication and adultery.
And I am inclined to believe that Pastor Greg Baldeo would readily agree for a law to be passed making it illegal for anyone to eat pork!!!. I am prepared to believe that Pastor Greg Baldeo would agree with a policy of immediately wiping out the Pork Industry in Jamaica whether investors in the pig rearing section would die of hunger or not.

In St. Matthew 5 verse 39 Jesus directed that:

“… whosoever shall smite thee on the right cheek, turn to him, the other also.”

Put bluntly, this verse is saying “if a man shaat u a bax on u right cheek u should tun di left cheek fi him to shaat u a bax on it”.
This, going by Pastor Greg Baldeo views of the Constitution and the Bible should be made law and any man disobeying it should be sent to prison. The following verse, verse 40 states:

“…and if any man will sue thee at the law, and take away thy coat, let him have thy cloak also.”

This should be made law and should I sue a Seventh Day Adventist for a five acre lot of land and I am successful, he should give me another five acres! This should be made law and any breach of this law should be punishable by imprisonment.
At Leviticus, Chapter 20, verse 10 it is provided as:

“…And the man that committeth adultery with another man’s wife, even he
thatcommitteth adultery with his neighbour’s wife, the adulterer and the adulteress shall surely be put to death.”

Again, this is a provision of the Bible that makes adultery a crime punishable by death.

THE PULPIT

We therefore should amend the laws to incorporate this provision. And I assure Pastor Greg Baldeo that some of the persons who would be put to death pursuant to this new law making adultery a crime punishable by death would be persons in his church and would include several persons in leadership of churches in Jamaica today.
All of us participating in the debate should bear in mind the rights of other citizens and other members of society. Those speaking as leaders of religious groups must be prepare to act and respect the Laws of Jamaica and Constitution of Jamaica. Above all, Pastor Greg Baldeo should always remember that it is the very Constitution that he seeks to belittle that has conferred on him the right to stand on a pulpit and give his view as a religious leader, free from any fear of being arrested, oppressed or killed as is happening in several countries throughout the world.

Pastor Greg Baldeo should therefore take the lead in protecting and defending the Constitution and not seek to use the pulpit as a platform from which to attack, ridicule and belittle the Constitution

PrEP Did Not Increase Sexual Risks in Study of Gay Men - Tenofovir Preexposure Prophylaxis Randomized Trial in the United States.

Pre-exposure prophylaxis (PrEP) did not cause men who have sex with men (MSM) to have riskier sex in a recent trial. However, the study has various important limitations and does not necessarily reflect a real-world setting. Publishing their findings in the Journal of Acquired Immune Deficiency Syndromes, researchers conducted a randomized, double-blind, placebo-controlled trial of Viread (tenofovir) as PrEP with 400 HIV-negative MSM in San Francisco, Atlanta and Boston who had reported anal sex with another man during the past year.

PrEP, in which an HIV antiretroviral or combination ARV pill is taken daily by HIV-negative people at high risk for infection, has been shown in recent research with MSM to significantly lower the risk of transmission. A major concern among researchers, however, is that PrEP will lead to a phenomenon known as risk compensation: If people taking the therapy consider themselves more invincible to infection, they might take more sexual risks.

The study participants were randomly and evenly divided into four groups, receiving either Viread or a placebo, and starting therapy either upon entering the study, or after a delay of nine months, and then continuing for 24 months. The researchers assessed the participants’ sexual risk factors at the beginning of the study, and then the participants returned every three months to give follow-up interviews.

During the follow-up period, the men’s risk factors either dropped or stayed level, with the average number of sexual partners and the percentage reporting unprotected anal intercourse (UAI) falling and the average number of instances of UAI not changing significantly. During the beginning nine-month period when one half of the group was delayed in taking either Viread or the placebo, changes in risk practices were similar between the two groups. These figures did not change significantly once both groups were taking the therapy or placebo.

The study has some very important limitations: The participants were told that PrEP had no known efficacy, so their willingness to take risks might not translate to real-world scenarios in which men know the therapy could protect them against HIV. The participants’ knowledge that they may have been taking a placebo may also have made them more cautious. Furthermore, self-reports of sexual risk taking may be unreliable, and the men may have been inclined to give more favorable replies, depicting their behavior as less risky than it actually was.

Abstract

OBJECTIVE::

To evaluate for changes in sexual behaviors associated with daily pill use among men who have sex with men (MSM) participating in a preexposure prophylaxis trial.
DESIGN::

Randomized, double-blind, placebo-controlled trial. Participants were randomized 1:1:1:1 to receive tenofovir disoproxil fumarate or placebo at enrollment or after a 9-month delay and followed for 24 months.
METHODS::

Four hundred HIV-negative MSM reporting anal sex with a man in the past 12 months and meeting other eligibility criteria enrolled in San Francisco, Atlanta, and Boston. Sexual risk was assessed at baseline and quarterly visits using Audio Computer-Assisted Self-Interview. The association of pill taking with sexual behavior was evaluated using logistic and negative-binomial regressions for repeated measures.
RESULTS::

Overall indices of behavioral risk declined or remained stable during follow-up. Mean number of partners and proportion reporting unprotected anal sex declined during follow-up (P < 0.05), and mean unprotected anal sex episodes remained stable. During the initial 9 months, changes in risk practices were similar in the group that began pills immediately vs. those in the delayed arm. These indices of risk did not differ significantly after initiation of pill use in the delayed arm or continuation of study medication in the immediate arm. Use of poppers, amphetamines, and sexual performance-enhancing drugs were independently associated with one or more indices of sexual risk.
CONCLUSIONS::

There was no evidence of risk compensation among HIV-uninfected MSM in this clinical trial. Monitoring for risk compensation should continue now that preexposure prophylaxis has been shown to be efficacious in MSM and other populations and will be provided in open-label trials and other contexts.

Anglican Church in the Caribbean: No to Same Sex Marriage

St. Kitts and Nevis (WINN): The Head f the Anglican Church in St. Kitts and Nevis Archdeacon Valentine Hodge is making it clear that the Church does not support gay marriage, or condone a homosexual lifestyle.

"I can only speak...on the behalf of the Anglican Church which is the church in the province of the West Indies…um at the moment we cannot marry in church two people of the same sex...We believe in indissoluble monogamous marriage that is something which should last for life.. indissoluble.. and, we also believe that it is something between a man and a woman," the Archdeacon said, speaking on WINN FM's Breakfast Show Thursday.

"We are not into same sex union in the province in the Caribbean, although we find that the Episcopal and the Church of Canada have been very much into that, but we haven’t reached that stage as yet and I think that we [aren't] going to in the foreseeable future given our constitution of the province of the West Indies. We are really holding on to the biblical tradition and there are certain passages of scripture like Romans Chapter One...that very clearly [says] what’s enunciated in terms of marriage."

The Archdeacon said that the issue of the rights’ of homosexuals and lesbians was one of the law and theology.

"The legal arguments knock out the theological ones almost immediately. If it becomes gay rights or it becomes a justice issue then of course that is a situation with its own stamp its own character and it own thought patterns and everybody wishes to have people feel free, free to be able to do the things that they want to do within limits and so from a legal position where going to find that if it becomes a justice issue we don’t have a leg to stand on with respect to the church’s position because that takes it immediately out of our theological perspective," the Archdeacon said.

"Yes people should have the right to do whatever, the right to freedom to engage in whatever activity they wish to engage in but we in the church bring our people back to the point of doing God’s will and that ‘s the big thing. I know that in other parts of the Caribbean you’ve had the decriminalization of homosexuality and that’s consenting adults, it’s not a crime, but that doesn't mean it’s not a sin."

The Archdeacon was commenting in the wake of a recent statement by the Prime Minister, who responding to a caller to his radio programme, said that the introduction of same sex marriage legislation is St. Kitts and Nevis was something that should be debated nationally.

At his monthly press conference on Wednesday, Prime Minister Dr. Denzil reiterated his position.

"Let us be open minded about this matter, let this matter be discussed um among our people among the stakeholders . The government is not saying what its own views are at this time because the time has not yet come but we are saying we support the fact that there should be open frank and honest discussions, because homosexuality is taking place. People of St Kitts and Nevis of the same sex are getting married in North America and in Europe, they are getting married. I can point to at least two to three people of this country who we all know who have been so called married. So I think let us not get away from this, this is already happening here in our country."

The Prime Minister said his recent comments had caught the attention of UNAIDS and he believed funding would be made available to facilitate a debate on issues related to the rights of homosexuals.

"To a large extent, it gets down to also involving the attorneys general from the Caribbean region, can we look at the present legislation with regard to buggery or homosexuality… the buggery law as people call it. Prostitution laws. How can you engage your own communities before it gets to the parliamentarians… engage them in discussing these matters as a human rights issue, because people have the right to determine their own sexual preferences and sexual orientation."

Dr. Douglas has been at the forefront of the advocacy in the Caribbean for ending discrimination against gays and lesbians.

Especially when the victims are found in the nude and have multiple wounds and even as media houses do not directly state the motive persons easily conclude they are gay murders when such variables are present.

As various groups continue to decry violence against the lesbians, gays, bisexuals and transgender (LGBT) in Jamaica, Assistant Commissioner of Police Devon Watkis has declared that there is no evidence showing members of that community encountering higher violent incidents than other members of the public.

Watkis, who was also speaking against the background of the recent killing of Montego Bay cross-dresser, 17-year-old Dwayne Jones, says all investigations are taken seriously and there is no target group.

"Our numbers generally show that we have had some violence committed against the citizens of Jamaica, inclusive of all groups," he told The Gleaner.

"I have no specific evidence outside of those isolated ones, that this group is a target group as opposed to the ordinary citizen," he said.

Jamaica has been described by some human-rights groups as the most homophobic place on Earth because of a perceived high level of violent crime directed at LGBT people.

The United States Department of State said in 2012, that homophobia was widespread in the country, and through the songs and the behaviour of some musicians, the country's dancehall culture helped perpetuate homophobia.

In its Human Rights Report, the State Department said that during 2012, Jamaica Forum for Lesbians All-sexual and Gays received 68 reports of sexually motivated harassment or abuse, which included 53 cases of attempted or actual assault, including at least two killings and 15 reports of displacements.

Political sociologist at the University of the West Indies Professor Anthony Harriott believes that every Jamaican is susceptible to violence.

"From my ongoing study of homicides, I can say that there is nothing extraordinary about the killings of gays to the extent that one can discern from the information in the police records that the victim is gay.

"As it relates to other forms of violence such as beatings, I do not know, but from my observation there might be a tendency of advocates for gay rights to name all violence against gays as anti-gay and we have to be careful with that," he said.

He added: "I think there is a lot of loose talk in just lumping up all victimization of people who happen to be gay as victimisation against gays. Truth is, I have encountered cases of murder where it is evident that it is as a result of one being gay, but those are few."

Meanwhile Watkis emphasized that everyone is entitled to their rights, but was quick to point out that responsibility is also critical.

"I won't dispute that there has been some cultural intolerance manifested in the public, but I have known individuals who have chosen that lifestyle but they have practiced their choices with responsibility and as a result they have not been subjected to any major taboo from the citizens of Jamaica," he said.

Many concluded that it was a lover's quarrel and hence adding further to the cynicism and dismissal of cries from the lobby for abuse of gay men in the majority. The murder of the two homeless homeless MSM last year which was first marketed as a homophobic killing then it turned out it wasn't as shown in that interview with the ED of JFLAG and Dionne Jackson Miller has only further served to make the agitation more difficult in justifying same and hence calls for tolerance. 
Arguable JFLAG and other groups do not have the capabilities to properly investigate and document from a socio-anthropological standpoint the incidents over the years but that ought to have been balanced with persons who know the lay of the land and have first hand experience when it comes to the actual LGBT populations and the issues that attend to them. The challenges that of gay on gay violence versus genuine homophobic or homo-negative ones need to be properly explained and also show that there is a link to the general homophobic nature in the national psyche that has an impact in even same sex exploitative relationships as well in other words gay for pay or hypermasculine types who fear their projected strength be lost or challenged in such sexual unions especially when they take on a hetero-relational construct to them so role play becomes so important (man and woman, bottom or top) and any deviation from such can and have had disastrous consequences.

Dwayne Jones's murder has other bits and pieces that have bot been brought into the discourse such as young pre-operative transgender individuals who after successfully fulfill their public female cisgender imperatives tend to go further in over exuberance and end up in problems. It was Dwayne's dancing that was the trigger factor leading to his sad end and this is in the absence of any social programs for such category of persons to learn the lay of the land and survival skills in navigating Jamaica, after all cross dressers have been going to such street dances and clubs for decades with incidents few and far in between.

The solution to combat the disbelief of "gay rage killings" which has been repeated time and time again by myself and other is the crisis communication needs to be tidied up and the TRUTH as per each case that involves a perceived gay victim must be gathered verified and presented outrightly so that no doubt must be left in the minds of the public and so called experts thus strengthening the credibility of the agitation for rights and recognition but at the rate pockets of the advocacy are going these days we are eons away from that. Will we learn?

Meanwhile there is growing unease with the stewardship of JFLAG from advocates locally and abroad regarding this same vexed issue of murders and how they are handled.

The Hypocrisy of Jamaican Anti Gay Groups & Selective Actions of Societal Ills


The selectivity of the anti gay religious voices on so called societal ills is examined in this podcast as other major issues that require the "church" to have spoken up including sexual abuse by pastors in recent times yet mere silence on those matters is highlighted.

Why are these groups and so called child rights activists creating mass hysteria and have so much strength for HOMOSEXUALITY but are quiet on corruption in government, missing children, crime in the country and so much more but want to stop same gender loving persons from enjoying peace of mind and PRIVACY?

Also is the disturbing tactic of deliberately conflating paedophilia with same gender sex as if to suggest reforming the buggery law will cause an influx of buggered children when we know that is NOT TRUE.

MSM/Trans homeless - From gully to graveyard



When are lives interrupted be allowed a real honest chance to move from interruption to independence and stability? I just cannot tell you friends.

An article appeared in the gleaner today that just sent me into sadness mode again with this ugly business of LGBTQI homelessness. The author of the piece needs an intervention too as he (Ryon Jones) uses terms such as cross dressers and or homeless men which if transgender persons are present they cannot be described or seen as such, sigh another clear display of the lack of impact and reach of so called advocacies and advocates who are more interested in parading as working but really aint having much impact as they ought to or claim.

We are told of houses being put together from time in memorial; the Dwayne’s House project seems dead in the water, the Larry Chang (named after a JFLAG cofounder) seems stuck in the mud and Colour Pink’s so called Rainbow House seems insignificant in relation to the size and scope of the national problem. JFLAG as presented on this blog is obviously not interested in getting their hands dirty really on homelessness save and except for using the populations as cannon fodder and delegating same; as far as I am concerned presenting them as victims of homophobia which is true but where are the programs and the perceived millions donated or granted since President Obama’s visit to address LGBTQ matters?

Former host of Dr Sexy Live on Nationwide radio and Sexologist tackles in a simplistic but to the point style homophobia and asks the poignant question of the age, What really are we as a nation afraid of?


It seems like homosexuality is on everyone's tongue. From articles in the newspapers to countless news stories and commentaries, it seems like everyone is talking about the gays. Since Jamaica identifies as a Christian nation, the obvious thought about homosexuality is that it is wrong but only male homosexuality seems to influence the more passionate responses. It seems we are more open to accepting lesbianism but gay men are greeted with much disapproval.

Dancehall has certainly been very clear where it stands when it comes to this issue with various songs voicing clear condemnation of this lifestyle. Currently, quite a few artistes are facing continuous protests because of their anti-gay lyrics. Even the law makers are involved in the gayness as there have been several calls for the repeal of the buggery law. Recently Parliament announced plans to review the Sexual Offences Act which, I am sure, will no doubt address homosexuality.

Just as I researched on-line in NOT EVEN five minutes and found a plethora of information and FACTS on Sexual Grooming (and thanks to Dr Karen Carpenter for some valuable insight I found out what Sexual Grooming was) so too must these fanatics go and do the same and stop creating panic in the country.

The hysteria continues from the Professor Bain so called protests to protect freedom of speech and bites at the credibility of the LGBT lobby collectively continues via Duppies Dupe UWI articles when the bigger principle of the conflict of interest in regards to the greater imperative of removing/preserving archaic buggery laws in the Caribbean dependent on which side one sits is of greater import when the professor’s court testimony in Belize went against the imperative of CHART/PANCAP goals is the more germane matter of which he was former head now temporarily reinstated via a court ex-parte injunction. JFLAG Excludes Homeless MSM from IDAHOT Symposium on Homelessness



Reminder

In a shocking move JFLAG decided not to invite or include homeless MSM in their IDAHO activity for 2013 thus leaving many in wonderment as to the reason for their existence or if the symposium was for "experts" only while offering mere tokenism to homeless persons in the reported feeding program. LISTEN TO THE AUDIO ENTRY HERE sad that the activity was also named in honour of one of JFLAG's founders who joined the event via Skype only to realize the issue he held so dear in his time was treated with such disrespect and dishonor. Have LGBT NGOs lost their way and are so mainstream they have forgotten their true calling?

Steps to take when confronted by the police & your rights compromised:


a) Ask to see a lawyer or Duty Council

b) Only give name and address and no other information until a lawyer is present to assist

c) Try to be polite even if the scenario is tense

d) Don’t do anything to aggravate the situation

e) Every complaint lodged at a police station should be filed and a receipt produced, this is not a legal requirement but an administrative one for the police to track reports

f) Never sign to a statement other than the one produced by you in the presence of the officer(s)

g) Try to capture a recording of the exchange or incident or call someone so they can hear what occurs, place on speed dial important numbers or text someone as soon as possible

h) File a civil suit if you feel your rights have been violated

i) When making a statement to the police have all or most of the facts and details together for e.g. "a car" vs. "the car" represents two different descriptions

j) Avoid having the police writing the statement on your behalf except incases of injuries, make sure what you want to say is recorded carefully, ask for a copy if it means that you have to return for it

Vacant at Last! ShoemakerGully: Displaced MSM/Trans Persons were is cleared December 2014





CVM TV carried a raid and subsequent temporary blockade exercise of the Shoemaker Gully in the New Kingston district as the authorities respond to the bad eggs in the group of homeless/displaced or idling MSM/Trans persons who loiter there for years.

Question is what will happen to the population now as they struggle for a roof over their heads and food etc. The Superintendent who proposed a shelter idea (that seemingly has been ignored by JFLAG et al) was the one who led the raid/eviction.

New Kingston Cop Proposes Shelter for Shoemaker Gully LGBT Homeless Population

The same cop who has factored in so many run-ins with the youngsters in the Shoemaker Gully (often described as a sewer by some activists) has delivered on a promise of his powerpoint presentation on a solution to the issue in New Kingston, problem is it is the same folks who abandoned the men (their predecessors) from the powerful cogs of LGBT/HIV that are in earshot of his plan.

This ugly business of LGBTQ homelessness and displacements or self imposed exile by persons has had several solutions put forth, problem is the non state actors in particular do not want to get their hands dirty as the more combative and political issues to do with buggery's decriminalization or repeal have risen to the level of importance more so than this. Let us also remember this is like the umpteenth meeting with the cops, some of the LGBT homeless persons and the advocacy structure.

BUSINESS DOWNTURN FOR THE WEED-WHACKING PROJECT FOR FORMER DISPLACED ST CATHERINE MSM



As promised here is another periodical update on an income generating/diligence building project now in effect for some now seven former homeless and displaced MSM in St Catherine, it originally had twelve persons but some have gotten jobs elsewhere, others have simply walked away and one has relocated to another parish, to date their weed whacking earning business capacity has been struggling as previous posts on the subject has brought to bear.

Although some LGBT persons residing in the parish have been approached by yours truly and others to increase client count for the men costs such as gas and maintenance of the four machines that are rotated between the enrolled men are rising weekly literally while the demand is instead decreasing due to various reasons.

What to Do .....




a. Make a phone call: to a lawyer or relative or anyone

b. Ask to see a lawyer immediately: if you don’t have the money ask for a Duty Council

c. A Duty Council is a lawyer provided by the state

d. Talk to a lawyer before you talk to the police

e. Tell your lawyer if anyone hits you and identify who did so by name and number

f. Give no explanations excuses or stories: you can make your defense later in court based on what you and your lawyer decided

g. Ask the sub officer in charge of the station to grant bail once you are charged with an offence

h. Ask to be taken before a justice of The Peace immediately if the sub officer refuses you bail

i. Demand to be brought before a Resident Magistrate and have your lawyer ask the judge for bail

j. Ask that any property taken from you be listed and sealed in your presence

Cases of Assault:An assault is an apprehension that someone is about to hit you

The following may apply:

1) Call 119 or go to the station or the police arrives depending on the severity of the injuries

2) The report must be about the incident as it happened, once the report is admitted as evidence it becomes the basis for the trial

3) Critical evidence must be gathered as to the injuries received which may include a Doctor’s report of the injuries.

4) The description must be clearly stated; describing injuries directly and identifying them clearly, show the doctor the injuries clearly upon the visit it must be able to stand up under cross examination in court.

5) Misguided evidence threatens the credibility of the witness during a trial; avoid the questioning of the witnesses credibility, the tribunal of fact must be able to rely on the witness’s word in presenting evidence

6) The court is guided by credible evidence on which it will make it’s finding of facts

7) Bolster the credibility of a case by a report from an independent disinterested party.

Notes on Bail & Court Appearance issues


If in doubt speak to your attorney

Bail and its importance -

If one is locked up then the following may apply:
Locked up over a weekend - Arrested pursuant to being charged or detained There must be reasonable suspicion i.e. about to commit a crime, committing a crime or have committed a crime.

There are two standards that must be met:

1). Subjective standard: what the officer(s) believed to have happened

2). Objective standard: proper and diligent collection of evidence that implicates the accused To remove or restrain a citizen’s liberty it cannot be done on mere suspicion and must have the above two standards

 Police officers can offer bail with exceptions for murder, treason and alleged gun offences, under the Justice of the Peace Act a JP can also come to the police station and bail a person, this provision as incorporated into the bail act in the late nineties

 Once a citizen is arrested bail must be considered within twelve hours of entering the station – the agents of the state must give consideration as to whether or not the circumstances of the case requires that bail be given

 The accused can ask that a Justice of the Peace be brought to the station any time of the day. By virtue of taking the office excluding health and age they are obliged to assist in securing bail

"Bail is not a matter for daylight

Locked up and appearing in court

 Bail is offered at the courts office provided it was extended by the court; it is the court that has the jurisdiction over the police with persons in custody is concerned.

 Bail can still be offered if you were arrested and charged without being taken to court a JP can still intervene and assist with the bail process.

Other Points of Interest

 The accused has a right to know of the exact allegation

 The detainee could protect himself, he must be careful not to be exposed to any potential witness

 Avoid being viewed as police may deliberately expose detainees

 Bail is not offered to persons allegedly with gun charges

 Persons who allegedly interfere with minors do not get bail

 If over a long period without charge a writ of habeas corpus however be careful of the police doing last minute charges so as to avoid an error

 Every instance that a matter is brought before the court and bail was refused before the accused can apply for bail as it is set out in the bail act as every court appearance is a chance to ask for bail

 Each case is determined by its own merit – questions to be considered for bail:

a) Is the accused a flight risk?

b) Are there any other charges that the police may place against the accused?

c) Is the accused likely to interfere with any witnesses?

d) What is the strength of the crown’s/prosecution’s case?

 Poor performing judges can be dealt with at the Judicial Review Court level or a letter to the Chief Justice can start the process

Battle Lines Javed Jaghai versus the state & the Jamaica Buggery Law

The feature seems destined for persons who are just catching up to the issues and repositioning JFLAG in particular in the public domain as their image has taken a beating in some respects especially on the matter of the homeless MSM front. They need to be careful that an elitist perception is not held after this after some comments above simplistic discourse, the use of public agitation as beneath some folks and the obvious overlooking of the ordinary citizen who are realy the ones who need convincing to effect the mindset change needed and the national psyche's responses to homosexuality in general.
